Kajiado court suspends implementation of contested land rates pending petition hearing

The Environment and Land Court in Kajiado county has temporarily barred the Kajiado county government from implementing or enforcing contested land rates and rents in the absence of a duly prepared, published and operational valuation roll, pending the hearing and determination of a petition challenging the charges.

The court order, issued by Lady Justice Judy Omange on September 29, 2026, follows a petition filed by Sheria Mtaani na Shadrack Wambui, Olkeri Residents Association and three others against the Kajiado County Assembly and the County Government of Kajiado.

According to the order, the conservatory orders restrain the county government from implementing or enforcing Sections 14(8), 14(9) and 14(13), read together with the Tenth Schedule of the Kajiado County Finance Act, 2026, to the extent that the provisions permit the imposition, demand, levy or collection of the contested land rates and rents without a duly prepared, published and operational valuation roll as required by law.

The court further directed that the petition be heard expeditiously, within four months, citing the public importance of the matter and its implications for the county’s revenue administration. The conservatory orders will lapse if the petition is not heard within that period, unless the delay is occasioned by the respondents, in which case the court may extend the orders.

The court order was presented to residents of Kajiado North sub-county during a public sensitisation forum held at Kasoro Bahari Stadium in Bulbul town. The meeting was organised by Sheria Mtaani na Shadrack Wambui to raise public awareness about the court’s decision and its implications for residents affected by the contested land rates and rents.

The forum provided an opportunity to explain the scope of the conservatory orders and the legal requirement for a duly prepared, published and operational valuation roll in the administration of land rates.

The court’s decision is an interim measure pending the determination of the petition on the legality of the contested provisions of the County Finance Act, 2026 by the Kajiado county government. The matter is before the Environment and Land Court under case number ELC/ELPET/E004/2026.
